Ж.1. ОБЯЗАННОСТИ ИССЛЕДОВАТЕЛЯ
а. Использование людей. Консультанты должны планировать, разрабатывать, проводить исследования и публиковать их результаты в соответствии с этическими принципами, местными и федеральными законами, учрежденческими правилами и научными стандартами, регулирующими проведение исследований с участием людей. При разработке и проведении исследований консультанты должны проявлять культуральную сензитивность.
б. Отклонения от стандартов практики. Консультанты должны получить экспертную консультацию и предпринять все меры предосторожности, которые позволили бы защитить права участников исследования в тех, случаях, когда проблема, поднимаемая в ходе исследования, предполагает отклонение от приемлемых стандартов практики (см. Б.6).
в. Меры предосторожности. Консультанты, проводящие исследования с участием людей, отвечают за их благополучие в ходе всего эксперимента и должны делать все необходимое для того, чтобы избежать оказания отрицательного психологического, физического или социального воздействия на испытуемых.
г. Ответственность главного исследователя. Основная ответственность за проводимое исследование лежит на главном исследователе. Все остальные лица, принимающие участие в проведении исследования, должны разделять общую ответственность и полностью отвечать за свои действия.
д. Минимальное вмешательство. Консультанты должны предпринимать все необходимые меры предосторожности, чтобы не оказать пагубных воздействий на жизнь испытуемых, которые были бы связаны с их участием в исследовании.

е. Учет различий. Консультанты должны быть сензитивны к различиям между людьми, а также к вопросам, связанным с участием в исследовании особых категорий испытуемых. В случае необходимости они должны обратиться за экспертной консультацией (см. А.2.а и Б.6).
Ж.2. ИНФОРМИРОВАННОЕ СОГЛАСИЕ
а. Раскрываемая информация. Получая информированное согласие на участие в исследовании, консультанты должны использовать такой язык, который был бы понятен будущим участникам исследования; также необходимо: 1) в точности описать цели и процедуры проводимого исследования; 2) рассказать обо всех экспериментальных или неиспытанныхранее процедурах; 3) рассказать о потенциальном риске и возможных неудобствах; 4) описать пользу, которую можно

получить, и изменения в людях или организациях, которые вполне могут произойти; 5) описать альтернативные процедуры, которые могут оказаться более предпочтительными для испытуемых; 6) дать испытуемым ответы на все их вопросы относительно предстоящих процедур; 7) оговорить все ограничения в соблюдении конфиденциальности; 8) сообщить, что испытуемые в любой момент могут взять свое слово обратно и отказаться от участия в исследовании (см. Б.1.е).

б. Обман. Консультанты не должны использовать обман при проведении исследования, если только альтернативные процедуры не являются недоступными, а предполагаемая польза от исследования не оправдывает используемый обман. Когда в методологические требования к проведению исследования входит обман или сокрытие какой-либо информации, требуется, чтобы, как только это станет возможным, исследователь объяснил причины, по которым он использовал этот прием.
в. Добровольное участие. Обычно участие в исследовании является добровольным, и за отказ от участия человека не наказывают. Недобровольное участие возможно только тогда, когда может быть доказано, что участие не окажет никаких пагубных воздействий на испытуемых, и то, что это важно для проведения исследования.
г. Конфиденциальность информации. Информация об испытуемых, полученная в ходе исследования, является конфиденциальной. В тех случаях, когда доступ к этой информации открыт для других людей, этика проведения исследования требует, чтобы об этом было сообщено испытуемым, так же как и о плане по защите конфиденциальности, что является частью процедуры получения информированного согласия (см. Б.1.д).

д. Неспособность дать информированное согласие. Когда человек неспособен дать информированное согласие, консультант должен предоставить соответствующее объяснение, получить согласие на участие и затем получить разрешение от человека, имеющего на это достаточные юридические полномочия.
е. Обязательства перед участниками. Консультант должен предпринимать все необходимые меры для того, чтобы выполнять обязательства, взятые перед участниками исследования.
ж. Объяснения, даваемые после сбора данных. После того как все данные были собраны, консультанты должны дать участникам полное объяснение сущности проводимого исследования, чтобы избавить их от любого недопонимания. Когда научные или человеческие ценности оправдывают искажение или сокрытие информации, консультанты должны предпринять все необходимые меры для того, чтобы никому не навредить.
з. Согласие на сотрудничество. Консультанты, согласившиеся сотрудничать с другими лицами в проведении исследования или публикации, должны взять на себя обязательство сотрудничать, проявляя в работе пунктуальность и предоставляя лишь точную и полную информацию.

и. Информированное согласие, получаемое от спонсоров. При проведении исследования консультанты должны предоставлять спонсорам, учреждениям и каналам, при помощи которых будет осуществляться публикация, возможность дать

информированное согласие. Консультанты должны осознавать свой долг перед будущими участниками исследования и быть уверены в том, что учреждение, в рамках которого проводится исследование, будет информировано о ходе работы и отблагодарено.
Ж.З. ОТЧЕТ О РЕЗУЛЬТАТАХ
а. Информация о факторах, которые могли оказать влияние на результат. Сообщая о результатах проведенного исследования, консультанты должны упомянуть обо всех факторах и условиях, известных исследователю, которые могли повлиять на результаты исследования или на интерпретацию данных.
б. Точность результатов. Консультанты планируют и проводят исследования, сообщают об их результатах, стараясь быть точными и стремясь к тому, чтобы минимизировать возможность того, что результаты могут быть неправильно поняты. Они должны предоставить доскональные объяснения ограниченности полученных данных и существующие альтернативные гипотезы. Консультанты не должны мошенничать при проведении исследования, искажать или неправильно интерпретировать данные, сознательно искажать полученные результаты.
в. Необходимость сообщать о неблагоприятных результатах. Консультанты обязаны сообщать другим консультантам о результатах любого исследования, имеющего профессиональное значение. Результаты, бросающие тень на учреждения, программы, оказываемые услуги, доминирующие представления или лиц, облеченных властью, не должны утаиваться.
г. Установление личности испытуемых. Консультанты, предоставляя данные другим специалистам, занимающимся проведением исследования, сообщая о результатах исследования или делая доступными первоначальные данные, должны позаботиться о том, чтобы было невозможно установить истинные личности испытуемых, за исключением тех случаев, когда сами испытуемые не давали разрешение сделать обратное (см. Б.1.ж и Б.5.а).
д. Воспроизведение исследования. Консультанты обязаны предоставить квалифицированным специалистам достаточное количество первоначальных исследовательских данных, чтобы при желании они могли повторить проведенное исследование.
Ж.4. ПУБЛИКАЦИЯ
а. Признание заслуг. Проводя исследование и сообщая о полученных результатах, консультанты должны быть знакомы и отдавать должное ранее проведенным исследованиям, посвященным данной теме; также они должны соблюдать законы об авторском праве и выражать признательность всем тем, кто ее заслужил (см. Е.1.гиЖ.4.в).
б. Выражение признательности. Консультанты должны выражать признательность посредством упоминания человека в качестве соавтора, вынесения ему благодарности, упоминания его имени в сносках или при помощи любого другого способа, соотнесенного с объемом проделанной работы. Имя человека, сделавшего наибольший вклад, должно упоминаться первым, а второстепенным техническим и профессиональным помощникам признательность должна быть выражена в примечаниях или вступительном слове.

в. Студенческое исследование. В статье, написанной главным образом на основе диссертационной или дипломной работы студента, сам студент должен значиться в качестве главного автора (см. E.l.r и Ж.4.а).
г. Двойная публикация. Студенты могут подавать рукописи на рассмотрение только в один журнал. Полная публикация или публикация значительной части рукописей в других журналах без получения одобрения и разрешения на то журнала, в котором эта публикация была сделана ранее, не допускается.
д. Профессиональная рецензия. Консультанты, занимающиеся рецензированием материалов, заявленных для публикации, проведения исследования или иных научных целей, должны уважать конфиденциальность и авторские права лиц, предоставивших этот материал.
Раздел 3: Решение этических проблем
3.1. ЗНАНИЕ СТАНДАРТОВ
Консультанты должны быть знакомы с Этическим кодексом, Стандартами практики и этическими кодексами других профессиональных организаций, в которых они состоят, или организаций, занимающихся лицензированием и сертификацией. Незнание или неправильное понимание этических обязанностей не является оправданием против обвинения в неэтичном поведении (см. Е.З.д).
3.2. ПОДОЗРЕВАЕМЫЕ НАРУШЕНИЯ
а. Этическое поведение. Ожидается, что члены профессиональных организаций должны следовать Этическому кодексу. Когда консультанты располагают достаточными основаниями для того, чтобы подозревать, что поведение другого консультанта является неэтичным, они должны предпринять соответствующие меры (см.ЗЛ.г и 3.2.д).
б. Экспертное консультирование. Когда у консультантов есть сомнения в том, является ли данная ситуация или данные действия нарушением Этического кодекса, они должны проконсультироваться с другими консультантами, хорошо разбирающимися в вопросах этики, коллегами или другими компетентными должностными лицами.
в. Конфликты в организациях. Если требования, выдвигаемые организацией, в которой работает консультант, вступают в противоречие с принципами, описанными в Этическом кодексе, то консультанты должны уточнить природу этого конфликта и выразить своим супервизорам и другим ответственным официальным лицам готовность следовать Этическому кодексу. Если это является возможным, то консультанты должны работать над тем, чтобы требования внутри организации полностью соответствовали принципам, предписываемым Этическим кодексом.
г. Неофициальное решение проблемы. Когда у консультанта есть достаточные основания полагать, что другой консультант нарушает этический стандарт, сперва он должен попытаться решить эту проблему неофициально, один на один, но лишь в том случае, если при этом не буду нарушаться права клиента на соблюдение конфиденциальности.

. Сообщение о подозреваемых нарушениях. Когда осуществить неофициальное решение невозможно или не удается, тогда консультанты, имея достаточные на то основания, должны предпринять ряд действий, таких как сообщение о подозреваемых этических нарушениях в национальные или федеральные комитеты по этике, но это делается лишь в тех случаях, когда права клиента на соблюдение конфиденциальности не находятся под угрозой.
. Необоснованные жалобы. Консультанты не должны инициировать, участвовать или способствовать составлению жалоб на нарушения этики в тех случаях, когда они ничем не обоснованы или имеют своей целью нанесение вреда другому консультанту, а не защиту прав отдельных клиентов или общества в целом.
СОТРУДНИЧЕСТВО С КОМИТЕТАМИ ПО ЭТИКЕ
Консультанты должны участвовать в процессе дальнейшей доработки Этического кодекса. Консультанты должны участвовать в исследованиях, работе и заседаниях комитета по этике Американской ассоциации консультирования, комитетов по этике других должным образом организованных ассоциаций или комитетов, в чью сферу полномочий входит работа с людьми, обвиненными в нарушении этических норм. Консультанты должны быть знакомь! с Принципами и Процедурами Американской ассоциации консультирования и использовать их в качестве справочного пособия при участии в дальнейшей доработке Этического кодекса.
